 of Protecting your Homestead Property

  • Deal only with a reputable company/person with years of experience and knowledge in Asset
    Protection, Estate Planning, Law, Legal Research, etc. You would be greatly surprised how few
    Realtors, mortgage brokers, loan officers, bankers, CPAs, even lawyers that are vaguely familiar
    with protecting one's domiciled homestead or have not protected their own home properly.    

  • Never, EVER, Never buy a "cookie cutter" generic form over the internet unless
    you thoroughly understand your state's the Homestead laws and their limitations. Would you be
    able to explain the legal purpose and the benefits that you are entitled to, maybe even in a court
    of law and to a judge ? This is where people get themselves into real deep legal trouble. Let's  
    use a hypothetical situation - Let's say you buy a Do-It-Yourself Revocable Trust form. Great,
    you saved plenty of money by not paying for an expensive lawyer, now a few years later, you
    get a notification of a certified letter from the IRS scheduling you for an audit and questioning
    your Do-It-Yourself Revocable Trust - Now what do you do? Where do you turn to for service?
    information? Assistance? Back to the Form Company? Maybe now you have to hire that
    expensive lawyer ...That's why there is a "Right" way and a "Wrong" way to do every thing.

  • Never, EVER, Never buy a "cookie cutter" generic form over the internet  unless
    you thoroughly understand your state's the Homestead laws and their limitations. THERE ARE
    SOME COMPETITORS THAT ARE TELLING CONSUMERS THAT ALL THEY NEED
    IS A CHEAP FORM - DON'T BELIEVE THESE IDIOTS !! THEY DON'T HAVE THE
    KNOWLEDGE OR THE EXPERIENCE. I personally have "first hand" knowledge when the
    Florida Dept of Revenue attempted to place a non-equity lien against my home even after I
    served them with my declaratory notice of Homestead. What prevented their unlawful action
    from occurring was from the knowledge of knowing what the limitations and benefits of properly
    homesteading my domiciled property and what exactly a declaratory notice of homestead
    actually does and what it doesn't protect against.

  • In a perfect world, all we would need a form but unfortunately we do not live in a perfect world.
    We are dealing with a very corrupt judicial system that is trying to disown the average citizen
    from their assets, money and rights. Thomas Jefferson said "The Greatest Threat to the
    American Citizen is.... the Judiciary"        

  • This is why this type of action is highly ill-advised and probably one of the worse actions
 that you can possibly do. Buying a cheap and very in-expensive Homestead "form"
 product from the internet (normal cost: $25-50), instead of purchasing a valuable
"service" is very poor method of asset protection and proper estate planning. Your
residential Home is your greatest financial asset that you & your family own - Do not
become "cheap" or "thrifty" in protecting your home & your family's home.
Remember,
the wise saying, "
You get what you pay for !" There is much truth & wisdom in this saying.
Never buy just the product, instead buy the company, it's services and its products.

  • If Litigation should befall you and your family's home then you have to be ready defend
    yourself in a court of law (Pro Se) or at least have the service provider who had originally
    assisted you in protecting your home to offer some valuable information (not legal advice). If
    you buy a homestead form off the internet then you are "dead in the water" and back to
    "square one". Be ready to spend thousands of dollars in hiring a attorney to represent you
    which could have been avoided from the beginning. There's a right way & a wrong way in
    protecting your most valuable financial asset - Your Home.

  • Just because a person has the title of "attorney", that does not mean he/she knows what they
    are doing, or possesses the correct knowledge or has your "best interests" first. The word
    "attorn" means "turn upside down" or"turn over" as in "to the King, all the property" and
    that is what they do today... the "state" being the "king" now, the people without lawful
    process in administrative "kings courts" or corporate "jurisdictions" - all totally outside of
    the constitutional restrictions placed originally on government against the People to protect
    us. We always recommend for any person to contact any legal entity or person of their
    choice but No One will ever know your rights, better than you !!!

  • "Corpus Juris Secundum" which mean "The Body of Law" or Legal encyclopedia,     
   Volume 7, Section 4: "Attorney & client: An Attorney's "first" duty is to the Courts (1)
   and the public (2) and not to the client (3), and wherever the duties to an attorney's  client  
  "conflict" with those interests that he/she owes his allegiance to, as an officer of the court in
   the administration of justice,
the former must yield to the latter.". The Biggest problem
   today is that People do
not know their own rights.
